Ave Maria University Sues Over Contraception Policy

Ave Maria University, a small Catholic institution in Collier County, filed a lawsuit Tuesday in opposition to the provision of the federal health care plan requiring all employers to provide free contraceptive services to their employees.

Earlier this month, responding to criticism from some religious groups, President Obama amended the policy saying women could apply directly to their insurance company for the benefits rather than through their employer. “These pharmaceutical drugs aren’t free today and so somebody’s going to be paying for them and of that is the employer, the insurance companies are going to pass the cost along,” he said. “We felt it was kind of a deception when it was said there was an accommodation when there really wasn’t one made.”

Towey said Ave Maria is prepared to discontinue its health plan rather than comply with the federal mandate. He said women’s right to contraception is not the issue and that employees at Ave Maria are free to decide on their own whether to use birth control.

The Becket Foundation for Religious Liberty filed the lawsuit in Federal Court for the Middle District of Florida.
